Schengen Information System — How to Check, Appeal, and Remove Your SIS Record in Poland

The Schengen Information System (SIS) is the shared EU database. It registers foreigners who should be refused entry to the Schengen area. If Poland or another Member State has entered your data into it, you can be turned back at the border, your visa application can be rejected, and your residence proceedings in Poland can run into serious problems. The good news: you have the right to check whether you're listed and to request correction or deletion of your data — and it costs very little. This guide explains how to do that from Poland.

Scope of this guide. SIS covers many categories of alerts (missing persons, stolen documents, return decisions). This article covers only entry-refusal alerts — the situation migrants most often run into. Other categories follow separate procedures.

How SIS Works in Practice

Two parallel databases matter for foreigners in Poland:

If a return-obligation decision (decyzja o zobowiązaniu do powrotu) carries an order of immediate enforceability (rygor natychmiastowej wykonalności), the entry in the Polish register is made right away — the transfer to SIS still waits for the decision to become final. Another Schengen state can also make an entry, acting independently and for its own reasons.

Why You Might Be Listed

The grounds are set out in Art. 435 §1 of the Act on Foreigners. The most common in practice:

• a final return-obligation decision (decyzja o zobowiązaniu do powrotu) with a re-entry ban;
• refusal of entry at the border on serious public-order or public-health grounds;
• a final refusal of residence on grounds of state security or public order;
• certain criminal convictions carrying residence-related consequences;
• serious breaches of visa or entry rules.

A decision refusing entry is issued by the commanding officer of the Border Guard post (komendant placówki Straży Granicznej). If you have received such a decision and aren't sure whether it triggers a SIS entry, treat it as if it does until UdSC confirms otherwise in writing.

How to Check Whether You're Listed

You have the right to file three separate requests, each on its own form, available at www.udsc.gov.pl → Third-country nationals → Register of foreigners...:

• Wniosek o udostępnienie informacji (request for information) — am I in the register or SIS, on what grounds, and for how long?
• Wniosek o sprostowanie danych (request for rectification) — the data is wrong.
• Wniosek o usunięcie danych (request for deletion) — the grounds for the entry no longer exist.

The filing procedure is identical for all three:

You may act through a representative (pełnomocnik). The representative must attach the original power of attorney, or a copy certified by a notary or by an advocate/legal counsel (adwokat/radca prawny). The certified copy of the documents must be signed with a qualified electronic signature, a trusted signature (profil zaufany), or a personal signature. If you live outside Poland and do not name a representative for service of documents, UdSC will call on you to appoint one within 7 days. Failing to respond means the request will be left without consideration (pozostawienie bez rozpoznania).

Fee and Deadlines

Every request is subject to a stamp duty (opłata skarbowa) of PLN 17, payable before filing, to the account of Centrum Obsługi Podatnika Miasta Warszawy: 21 1030 1508 0000 0005 5000 0070 (SWIFT CITIPLPX), with the payment title "opłata skarbowa za udostępnienie informacji" (or "sprostowanie" / "usunięcie", matching the form you're filing). Keep the confirmation. You won't get the fee back — you pay it regardless of the answer.

UdSC has 30 days to respond for third-country nationals, and 2 months for EU citizens and their family members.

How Long an Entry Lasts — and What to Do About a Refusal

The retention period depends on the specific legal ground (Art. 438 §1) — UdSC does not publish a single table of deadlines. To learn the end date of your entry, file the wniosek o udostępnienie informacji and wait for a written answer.

If UdSC's answer to your request for information, rectification, or deletion is negative, you have the right to file a complaint with the Regional Administrative Court in Warsaw (WSA w Warszawie) within 30 days of the decision being delivered.

Withdrawing a re-entry ban does not automatically remove the data from SIS on the same day — if you're still being turned back at the border despite the ban being lifted, file the wniosek o usunięcie danych and cite the withdrawal decision in it.

What to Do If Another Country Made the Entry

UdSC can only tell you about entries made by Poland. If the entry was made by another Schengen state, you can approach that country's data-protection authority directly — every EU country has one, and each handles SIS requests under its own procedure.

Your Data-Protection Rights

The data in the register and in SIS are personal data covered by the GDPR (EU Regulation 2016/679). Independent of your requests to UdSC, you have the right to information about processing, to rectification, and to deletion once the legal basis no longer applies. The supervisory authority in Poland is the Personal Data Protection Office (Urząd Ochrony Danych Osobowych, UODO) — if UdSC doesn't respond in time or you believe a refusal is unjustified, you can file a complaint there; the UODO procedure runs in parallel with the UdSC procedure.

Practical Order of Action

1. File the wniosek o udostępnienie informacji with the PLN 17 fee. Wait for the answer (30 days / 2 months).
2. If the entry was made by another country — approach that country's data-protection authority.
3. Choose the right form: rectification — the facts are wrong; deletion — the grounds no longer exist.
4. Refusal? You have 30 days to file a complaint with the WSA in Warsaw.
5. Appealing the underlying decision (e.g. the return obligation)? That's a separate track — check the instructions (pouczenie) on that decision; its deadline runs independently of the SIS request.

A Final Word

A SIS entry is a serious matter, but the process for checking and removing your data is simple. The fee is small, the forms are ready to use, and response deadlines are known in advance. Even after a refusal, you have 30 days to appeal to the court. Take the steps in order, and keep every confirmation and every reply.
